2. Description of Services

UGC Creator AI provides:

AI avatar-based video generation for marketing content
Text-to-speech synthesis in 40+ languages
Video replication and analysis tools
Multi-platform export (TikTok, Instagram, YouTube, Meta)

Our services use artificial intelligence to generate synthetic media content based on your inputs.

3. Account Registration

3.1 Eligibility

You must be at least 18 years old and have the legal capacity to enter into these Terms.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

3.3 Accurate Information

You agree to provide accurate, current, and complete information during registration and to update it as necessary.

4. Subscription and Credits

4.1 Pricing Plans

Starter: $69/month (or $49/month billed annually)
Growth: $99/month (or $69/month billed annually)
Pro: $139/month (or $99/month billed annually)

4.2 Credits System

Video generation consumes credits based on the feature used
Unused credits expire at the end of each billing cycle
Additional credit packs may be purchased separately

4.3 Billing

Subscriptions are billed in advance on a recurring basis
You authorize us to charge your payment method automatically
Prices may change with 30 days' notice

4.4 Refunds

All purchases are final and non-refundable, except where required by law or at our sole discretion.

5. User Content and Licenses

5.1 Your Content

You retain ownership of all content you upload to UGC Creator AI, including images, videos, scripts, and product photos.

5.2 License to Us

By uploading content, you grant UGC Creator AI a non-exclusive, worldwide license to process, transform, and store your content solely for the purpose of providing our services.

5.3 AI-Generated Content Ownership

You own full commercial rights to all AI-generated content created through your account. You may use this content for any lawful purpose, including commercial advertising.

5.4 Your Representations

You represent that you have all necessary rights to the content you upload and that your use of our services does not infringe any third-party rights.

6. Prohibited Uses

You agree NOT to use UGC Creator AI to:

6.1 Deceptive Content

Create deepfakes or synthetic media intended to deceive viewers about real individuals
Generate content that impersonates real people without their consent
Produce misleading testimonials or fake endorsements

6.2 Harmful Content

Create content that promotes violence, hatred, or discrimination
Generate illegal, defamatory, or harassing material
Produce content involving minors in any inappropriate context

6.3 Fraudulent Activities

Use AI-generated content for scams, phishing, or fraud
Create fake news or disinformation
Circumvent platform policies (TikTok, Meta, YouTube, etc.)

6.4 Technical Abuse

Attempt to reverse-engineer our AI models
Use automated systems to abuse our services
Share account credentials or resell access

Violation of these prohibitions may result in immediate account termination without refund.

7. AI Content Disclosure

7.1 Platform Compliance

Major advertising platforms (TikTok, Meta, YouTube) require disclosure of AI-generated content. You are responsible for:

Adding appropriate AI disclosure labels to your content
Complying with each platform's synthetic media policies
Using our optional AI disclosure overlays when required

7.2 Transparency

We encourage transparent use of AI-generated content. Misrepresenting AI avatars as real people may violate platform policies and applicable laws.

8. Intellectual Property

8.1 Our IP

UGC Creator AI, including our AI models, platform, code, and branding, is protected by intellectual property laws. You may not copy, modify, or distribute our technology.

8.2 AI Avatars

Our AI avatars are synthetic characters. They do not represent real individuals. You receive a license to use avatar appearances in generated content but do not own the underlying avatar technology.

8.3 Third-Party Content

Respect third-party intellectual property. Do not upload copyrighted material without proper authorization.

8.4 Third-Party AI Technologies

UGC Creator AI integrates third-party AI services including Veo 3.1, Sora 2, ElevenLabs, and other providers. UGC Creator AI is an independent product and is not affiliated with, endorsed by, or sponsored by Google, OpenAI, ElevenLabs, or any other AI provider. All trademarks belong to their respective owners.

9. Disclaimers

9.1 Service Availability

We strive for 99.9% uptime but cannot guarantee uninterrupted service. AI generation times may vary.

9.2 AI Limitations

AI-generated content may not always meet expectations. Results depend on input quality and complexity.

9.3 No Warranty

Services are provided "AS IS" without warranties of any kind, express or implied.

10. Limitation of Liability

To the maximum extent permitted by law:

UGC Creator AI is not liable for indirect, incidental, or consequential damages
Our total liability shall not exceed the amount you paid in the 12 months preceding the claim
We are not responsible for how you use AI-generated content or any consequences thereof

11. Indemnification

You agree to indemnify and hold harmless UGC Creator AI, its affiliates, and their respective officers, directors, and employees from any claims, damages, or expenses arising from:

Your use of our services
Your violation of these Terms
Your infringement of third-party rights
Content you create using our platform

12. Termination

12.1 By You

You may cancel your subscription at any time through your account settings. Access continues until the end of your billing period.

12.2 By Us

We may suspend or terminate your account for:

Non-payment
Suspected fraudulent activity
Any reason with 30 days' notice
